The President may appoint active members to standing committees to conduct specific business of the T.A.L.E.P.I.
The President and governing board shall constitute a quality review committee whenever a situation arises requiring an official review of an examination conducted by a public agency examiner.
Public criticism regarding professional conduct of one member by another, other than before the Committee of Standards and Ethics or the Board of Directors, in writing and signed by the writer, is condemned and expressly forbidden for all T.A.L.E.P.I. members.
Any member who knowingly makes a false certification or endorsement regarding an applicant's eligibility and/or qualifications, will be subject to termination of membership.
Robert's Rules of Order will be used as a guideline for conduction all official meetings of the T.A.L.E.P.I.
ARTICLE I: DESIGNATION
The name of this Association shall be the "Texas Association of Law Enforcement Polygraph Investigators," herein referred to as the T.A.L.E.P.I.
ARTICLE II: OBJECTIVES
The objectives of the T.A.L.E.P.I. will be:
1. To support and develop cooperation of all polygraph associations that share the views and concerns of the T.A.L.E.P.I.;
2. To act as a voice for law enforcement polygraph investigators in Texas legislature or legislative matters;
3. To provide a forum for the exchange of ideas and information relative to law enforcement polygraph investigators;
4. To facilitate the participation of law enforcement polygraph investigators in training sessions and in service seminars by maintaining the costs of such training vehicles at the lowest possible levels, and utilizing governmental facilities whenever legal and feasible;
5. To increase professionalism among its members via application of membership requirements that reflect the highest codes of ethics and morality;
6. To assist by input and concern the licensing and/or regulating agencies that do now or may in the future license and/or regulate polygraph investigators in Texas.
ARTICLE III: OFFICERS AND BOARD OF DIRECTORS
A. The Officers of the T.A.L.E.P.I. shall be:
1. President
2. Secretary/Treasurer
3. Three (3) Directors
4. Vice President
B. The President, Vice President and Secretary/Treasurer shall hold their respective offices for a term of two (2) years being elected at the annual seminar by ballots cast by eligible members, or until their respective successors in office have been duly elected or appointed as the case may be. (Amended by vote of membership on 6-21-2007)
C. The directors shall hold their offices for a term of three (3) years, each staggered whereby one Director will be elected at the annual seminar by ballots cast by eligible members.
D. Only Active, Life and Retired members are eligible for election to any office, provided they possess the qualification requirements.
E. The Board of Directors shall consist of: 1. President 2. Secretary/Treasurer 3. Three Directors 4. Immediate Past President 5. Vice President 6. Advisory Member
F. Three or more members meeting and voting in session will constitute a quorum.
G. All decisions concerning the application of policy and procedures of the T.A.L.E.P.I. will be decided by the majority of voting Association Officers.
H. The Officers of the T.A.L.E.P.I. will meet in session at least twice per calendar year once during the summer and once during the winter, and at any other times when a special session is called by the President.
I. All Officers of the T.A.L.E.P.I. will serve without compensation.
J. No Officer of the T.A.L.E.P.I. may hold office in any other polygraph association.
K. The President will act as Chief Executive of the Board.
L. The Secretary/Treasurer shall keep the records and minutes of the T.A.L.E.P.I., included but not limited to, a complete and accurate accounting of the proceedings of the annual seminar, receive all moneys due the T.A.L.E.P.I. and its members. She/He shall be responsible for correspondence relating to the T.A.L.E.P.I. and issue notices of all meetings of the T.A.L.E.P.I. and Board of Directors. She/He shall keep a current record of the membership and will insure publication of an annual roster to be furnished eligible members annually. She/He will keep a record of all financial transactions of the T.A.L.E.P.I. and perform all other duties normally performed by a Secretary/Treasurer. She/He will issue to each new member, a certificate of membership which shall remain the property of the T.A.L.E.P.I. and upon payment of current dues, a membership card and certificate validation indicator that indicates the year of validation. She/He shall draw and sign warrants for expenses of the T.A.L.E.P.I. All expenses ssociated with the official functions of the office will be paid by the T.A.L.E.P.I. She/He will personally file a report at each Seminar and as otherwise directed by the Board of Directors.
M. The Directors will have the responsibility of transacting the business between meetings. They are subordinate to T.A.L.E.P.I. and must abide by constitutional rulings.
ARTICLE IV: MEMBERSHIP
A. Membership in T.A.L.E.P.I. is divided into six (6) classes.
1. Active
2. Associate
3. Affiliate
4. Honorary
5. Life
6. Retired
B. Active members
1. Active members of T.A.L.E.P.I. will be employees of a governmental agency of the State of Texas or a subdivision thereof, who are licensed to practice polygraph in Texas and are employed by such agency as a supervisor over polygraph or as a polygraph investigator itself. Such agencies include: Texas Department of Public Safety; Texas Department of Criminal Justice; State of Texas municipal, sheriffs, or rural departments, or other law enforcement and/or investigative agencies of the State of Texas.
2. Active members are authorized to vote in general matters affecting the T.A.L.E.P.I.
C. Associate Members
1. Associate members will be active polygraph investigators within the definition of an Active member of T.A.L.E.P.I., who are employed by a law enforcement agency of another state or territory of the United States or of a governmental agency of the United States, A Texas Licensed Examiner who is honorably retired from a governmental agency, or a Texas Licensed Examiner who conducts polygraph for any criminal justice agency in the State of Texas who is in commercial practice of a private examiner
2. Associate members are ineligible to vote in any matters affecting the T.A.L.E.P.I. D.
Affiliate Members
1. Affiliate members will be any person other than a polygraph investigator who demonstrates a genuine interest in polygraph.
2. Affiliate members may also include polygraph manufacturers or representatives or other persons who may be involved in instrument or technique research.
3. Affiliate members are ineligible to vote in any matters concerning the T.A.L.E.P.I.
E. Honorary Members
1. Honorary membership may be granted by a unanimous vote of the Officers of the T.A.L.E.P.I. to any person who is deemed to contribute to T.A.L.E.P.I. in a manner of such magnitude as to be considered superlative and unique.
2. No annual fee shall be levied upon or charged against an Honorary Member and such member shall not be entitled to vote.
F. Life Members
1. Life membership shall consist of all Past Presidents.
2. Life members will not be required to pay annual dues or seminar registration fees.
3. Life members have the right of voice, vote and eligibility for election to any office.
G. Retired Members
1. Retired membership shall consist of any former Active Member of T.A.L.E.P.I. who retires honorably from his/her agency.
2. Retired members are authorized to vote in general matters affecting the T.A.L.E.P.I.
3. Retired members have the right of voice, vote and eligibility for election to any office.
H. The Membership Committee shall have the authority to promulgate such rules as it deems necessary, with the advise and consent of the Board of Directors. In absence of a Membership Committee, the Secretary/Treasurer, with the advise of the president, may assume the responsibility for membership application processing.
ARTICLE V: ANNUAL FEES AND VOTING RIGHTS
A. The annual membership fee shall be fixed at a general meeting and shall be payable by each member, not otherwise excluded, upon receipt of the statement from the Secretary/Treasurer, who shall issue an official receipt for such payments.
B. Any non-member or member in default of payment of annual fees shall not be entitled to attend any meeting of the T.A.L.E.P.I., or to be listed in the membership directory.
C. All elected officers of T.A.L.E.P.I. including the President, Secretary/Treasurer, Vice President and the Directors while honorably serving in their elected office shall not be required to pay any conference or annual membership dues or fees. (Added by vote of membership on 6-21-2007)
ARTICLE VI: COMPLIANCE WITH THE CONSTITUTION
A. Every member of the T.A.L.E.P.I., upon admittance to membership, shall be deemed to have agreed to comply with the Constitution as hereby established and undertakes to maintain it.
B. Members shall have the right to a fair and impartial hearing before the Board when a written grievance is made to the Board of Directors. A member may file a letter of grievance in any case in which unlawful activities or moral turpitude involves a member of T.A.L.E.P.I. The President shall direct the gathering of credible information for presentation to the Board of Directors. A member accused of unlawful conduct or moral turpitude shall have the right to present credible evidence in rebuttal to any complaint. The Board of Directors shall hear the issue and the voting membership shall ratify any expulsion. In minor matters, not worthy of expulsion, a member may be censured by the Board of Directors by a majority vote.
ARTICLE VII: APPLICATION FOR MEMBERSHIP
A. Any person qualified to become a member of the T.A.L.E.P.I. as defined in Article IV herein, may make application in such form and manner as the Board of Directors may from time to time prescribe.
